Terms of Service
By downloading or using Benzai ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.
1. Description of Service
Benzai is a personal music player that retrieves publicly available audio stream metadata from YouTube. It does not host, store, or distribute any copyrighted content. All audio is streamed directly from YouTube's servers.
Benzai optionally offers a cloud-synced account ("Benzai Account") that lets you back up and restore your library (playlists, liked songs, history, and settings) across devices. Creating an account is optional — the App functions fully without one.
2. User Accounts
To create a Benzai Account, you must provide a valid email address and choose a password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Ensuring your account information is accurate and up to date.
You may delete your account at any time from the Profile screen in the App. Deletion is permanent — all cloud-synced data is erased immediately. Local data on your device is not affected.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree to use the App for personal, non-commercial listening only. You must not:
- Use the App to download or redistribute copyrighted content.
- Circumvent, disable, or interfere with security features of the App or related services.
- Use automated tools to access or abuse the App's backend services.
- Use the App in any way that violates applicable law.
4. YouTube Terms of Service
The App uses YouTube data. Your use of YouTube content is also subject to YouTube's Terms of Service (youtube.com/t/terms) and Google's Privacy Policy (policies.google.com/privacy). Hikari Labs is not affiliated with or endorsed by YouTube or Google.
5. Intellectual Property
All audio, video, and associated metadata retrieved through the App remains the property of its respective rights holders. Benzai does not claim ownership of any third-party content.
6. Disclaimer of Warranties
The App is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or compatible with all devices.
7. Limitation of Liability
To the fullest extent permitted by law, Hikari Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages.
8. Updates and Changes
We may update the App and these Terms at any time. Continued use after an update constitutes acceptance. If a forced update is delivered through the App's in-app update system, continued use requires installing the update.
9. Termination
You may stop using the App at any time. If you have a Benzai Account, you may delete it from the Profile screen to remove all associated cloud data.
We reserve the right to discontinue the App or suspend accounts at any time. Your right to use the App terminates automatically if you breach these Terms.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
